Comunicat de presã al primãriei Chişinãului

Primarul municipiului Chişinãu Dorin Chirtoacã a avut ieri o întrevedere cu delegaţia Parlamentului European, care a venit la Chişinãu pentru a se documenta asupra evenimentelor postelectorale din Republica Moldova.

Tineri care au fost arestaţi dupã evenimentele din 7 aprilie, însoţiţi de pãrinţi şi rude, au venit la Primãrie sã spunã europalamentarilor despre ce li s-a întâmplat, cum au fost bãtuţi, maltrataţi şi umiliţi de poliţie. Printre cei prezenţi  au fost şi pãrinţii tinerilor decedaţi Valeriu Boboc şi Ion Ţibuleac, fostul deţinut politic Andrei Ivanţoc, studenţi şi elevi, printre care unul de doar 12 ani, care au povestit cum au fost maltrataţi la comisariatele de poliţie şi chiar ameninţaţi cã vor fi violaţi.

Primarul Dorin Chirtoacã şi-a exprimat nedumerirea în legãturã cu graba membrilor delegaţiei Parlamentului European. Dorin Chirtoacã a declarat cã  „aici se aflã realitatea despre evenimentele din 7 aprilie, mai ales cã toţi tinerii au protestat paşnic, iar majoritatea au fost vânaţi în stradã”.  Primarul general şi-a manifestat speranţa cã faptele autoritãţilor moldovene nu vor mai fi tolerate de Uniunea Europeanã. „Acum luptãm pentru ca Europa sã-şi schimbe atitudinea faţã de autoritãţile din Moldova şi sã recunoascã adevãrul despre cele întâmplate”, a spus Dorin Chirtoacã tinerilor care au venit ieri la Primãrie.

„Ne exprimãm speranţa cã Parlamentul European va lua atitudine şi va adopta o rezoluţie privind situaţia din Republica Moldova. În acelaşi timp, Uniunea Europeanã va avea posibilitatea sã-şi analizeze atitudinea faţa de Guvernul RM, luând în considerare cã în ultimii 10 ani, cel puţin 8 rezoluţii ale Parlamentului European privind Republica Moldova au fost adoptate, dar nu au fost implementate în realitate niciodatã. Încãlcarea drepturilor omului, a libertãţii de expresie, a libertãţii presei, independenţei justiţiei, autonomiei locale etc., a devenit deja o tradiţie. Nerespectarea de cãtre Guvernul Republicii Moldova  a  valorilor fundamentale europene şi internaţionale nu mai pot fi tolerate”, se spune în scrisoarea adresatã delegaţiei Parlamentului European de cãtre primarul Dorin Chirtoacã. Dear Excellencies,
The Republic of Moldova encounters severe violations of human rights. Following the manifestations on 7th of April 2009, when the presidential and parliament buildings were seized by the protesters, the Moldovan police unleashed a wave of mass terror and intimidation against the citizens. Youth, including minors, has been particularly targeted. Journalists who did not participate in the protests were arrested along with protesters, both violent and peaceful. We condemn the acts of terror, violence, intimidation, and repression of unprecedented brutality which the authorities have committed against Moldovan citizens, especially the young (including minors), following the April 7, 2009 protests.
The police acted in full force and have been arresting people on the street, students in high schools, universities and youth hostels, but also church attendants returning from the Easter mass. The arrest procedure is not followed through. Those apprehended, men or women, are beaten with cruelty and subjected to inhumane and degrading treatment. There are reports of torture, rapes and several cases of deaths. Three deaths have been documented (those of Valeriu Boboc, Ion Ţibuleac and Eugen Tapu), of which the first was undoubtedly a result of the police’s use of force between the night of April 7th and now, and not as a result of the protests. We do not exclude the possibility that there are more such cases being covered up.
Not all arrests have been reported. There are still parents in search of their missing children to whom access to their children’s’ whereabouts is denied. We report that according to the information we have at least 3 disappeared persons: Serghei Donici, 19 years old; Alexandru Galinschi, 27 years old; and Tudorache Mihail, 23 years old.
Those released contend that the arrested are kept in dreadful conditions (15-20 people in a 10 m2 cell), beaten with brutality and compelled to sign under false statements. Spot trials are held in police premises with no or limited access to defense. The access to detention facilities is denied including to lawyers and human rights organizations. The repeated requests of the mayor of Chisinau to access the detention facilities were irrefutably turned down. Those arrested have not received food or water for 48 hours or more. The hospitalization of those who are mistreated is refused (see the case of Vadim Ungureanu – hospitalization refused by judge and prosecutor, though an ambulance was called, while a medical council requested the pacient’s admission to a hospital).
The Minister of Internal Affairs (MAI) presents incorrect and incomplete information about the arrests that have taken place. According to the MAI, 172 people were arrested and penalized following the protests (

However, on the basis of calls from the family members of those who have disappeared and of the accounts of those who have been freed, the Mayor’s Office of the City of Chisinau has created a database with at least 318 people who have been arrested and penalized (www.chisinau.md). We have accounts that show that some of those who have been arrested were not issued arrest reports and do not appear in the records of the MAI, though they have been detained and maltreated. We estimate that the total number of those pursued by the police surpasses 1000. In order to cover up the cases of2 maltreatment, those arrested have been sent to police stations and prisons outside of Chisinau. There is information that in order to hide the abuses, the detained citizens are transported in other municipalities like Taraclia, Vulcanesti.
To this day the government has rejected measures undertaken by NGOs and local authorities to defend human rights in the police stations and prisons in the Republic of Moldova where violence against detainees takes place. There are documented threats against those who have offered testimony against the police and against the violence used during the period of their detention. Vadim Ungureanu was threatened that “he would not escape with alife if he continues to talk to the press” about what happened to him. The Mayor’s Office of the City of Chişinău notes with regret that the communist regime continues to terrorize the civilian population in the capital of Moldova. Although an end to the repressions was announced, we continue to document cases of the use of physical force by the police against Moldovan citizens. The government has a cynical and irresponsible attitude. Besides the fact that those detained are beaten, tortured, and subjected to inhumane and degrading treatment, the police levy fees on those arrested for the period of their detention, and officials of the Republic of Moldova have dared to say that it was not lesions that were found on the bodies of victims of repression, but paint. We reiterate the fact that, while the law of the local public administration (art. 29, alin.1) lit.t)) stipulates as a basic attribute of the mayor the verification of violations of the law committed by individuals or organizations within the municipal jurisdiction, nevertheless the course of the past week the access of the mayor as well as that of representatives of the mayor’s office to the places of detention has been constantly impeded. We express our regret that the representatives of international institutions, organizations for the protection of human rights, and the press have not had and do not have access to the places of detention. Likewise, we are worried about the fact that to date special missions to verify the situation on site in the places of detention have not been sent or created. We call for an international investigation of the severe and massive violations of human rights reported in the Republic of Moldova over last 21 days. The victims demand a prompt and efficient response. With this letter we request the immediate involvement of the international community, and we insist upon:
•An end to the inhumane and degrading treatment and torture in the places of detention;
•The cessation of terror, kidnapping, threats, and intimidation;
•The ensuring of access to the places of detention by lawyers, NGOs, and the press;
•The guarantee of the rights of persons who are detained, especially the right to defense in court;
•A complete report on the detentions carried out and the charges brought;
•The punishment of those guilty of committing the abuses mentioned.
We express our hope that the European Parliament will take attitude and will pass a Resolution regarding the situation in the Republic of Moldova. Meantime the European Union will have a possibility to analyze further its approach towards the Moldovan Government, taking into account that previously, in the last 10 years, at least 8 resolutions of the European Parliament regarding Moldova were passed, but
no real improvement of the democracy occurred. The lack of: respect for human rights, freedom of expression, independence of media, independence of justice, local autonomy etc, became already a tradition. The disregard of the Moldovan Government for the fundamental European and international values should not be tolerated anymore.
